Technical Assistance for Assessing Moldova’s Alignment with Stipulated EU Legislation

Main Beneficiary: Ministry of Infrastructure and Regional Development

Objectives: The overall objective of this technical assistance was to conduct analysis of particular Moldovan legislation against the EU acquis, analysis of the draft aligned legislation, and strengthen the institutional capacity of beneficiary authorities thus assisting the European Commission in the assessment process.

Results: The project resulted in assessment of the Draft Order of the Minister on the Structure and Content of Railway Accident and Incident Investigation Reports, prepared in alignment with Commission Implementing Regulation (EU) 2020/572 on the reporting structure to be followed for railway accident and incident investigation reports and Draft Government Decision on the approval of the Regulation on the inspection of the safe operation of ro-ro passenger ships and high-speed passenger craft in accordance with Directive  (EU) 2017/2110, taking into account the broader EU and international maritime safety network

The assessment comprised systematic article-by-article comparison of relevant EU provisions with Moldovan legislation. Tables of Concordance were revised, and legal references against the draft legislation were verified. A report identifying gaps, inconsistencies, and areas of partial or non-alignment, and classifying the provisions according to the agreed assessment methodology was prepared.

Conclusions and next steps to be done by Moldova authorities:

The Moldovan authorities should consider the recommendation for amendments to the Draft Order of the Minister on the Structure and Content of Railway Accident and Incident Investigation Reports, to ensure that it is fully aligned with Commission Implementing Regulation (EU) 2020/572.

Moldova should adopt the pending national regulation on passenger registration, prepare the technical and administrative groundwork for the EU inspection-database interface ahead of accession, and address inspector staffing and competence through training and cooperation with other maritime administrations.
