Main Beneficiary: Ministry for Recovery, Infrastructure and Transport of Ukraine
Objectives: This technical assistance contributed to a more integrated, effective, and efficient maritime sector in Ukraine by enhancing regulatory alignment with the relevant EU acquis, improving structuring of institutional responsibilities and enabling the implementation of more targeted policies focusing on the environmental sustainability and pollution control.
Results: The assignment resulted in the preparation of a Regulatory and Policy Review and Gap Assessment Report, identifying gaps and constraints in the Ukrainian regulatory and institutional framework relevant to the EU Maritime Transport acquis. Building on these findings, an EU Maritime Acquis Transposition Plan was prepared, outlining the specific measures and timeline required to achieve full transposition of the relevant acquis. In addition, an EU Maritime Acquis Implementation Roadmap and Impact Assessment was delivered, incorporating the results of a regulatory impact assessment and an estimation of costs and benefits under various scenarios, together with an evaluation of the human, technical, and financial resources required for effective implementation. Finally, the legislative package in Ukrainian was delivered in two parts: Part 1, comprising draft laws, by-laws, and supporting documentation for Directive (EU) 2016/802 (selected articles) and Directive 2005/35/EC on ship-source pollution, together with its amendments; and Part 2, covering Regulation (EU) 2023/1805 and Regulation (EU) 2015/757 under the same format, ensuring full approximation with the specified scope of the EU Maritime acquis.
Conclusions and next steps to be done by Ukraine authorities:
The relevant Ukrainian authorities would need to advance the drafted legislative package through the national adoption process, allocate the necessary institutional, technical, and financial resources for its implementation, and strengthen enforcement and monitoring capacity within the maritime sector to ensure the acquis is applied effectively in practice. Effective adoption and implementation of this legislative package would result in a maritime transport sector in Ukraine that is more closely aligned with EU rules and standards, safer, more environmentally sustainable, and better integrated with the EU market.
